Donor (Giver)

The person transferring the asset. Must be at least 21 years old and of full mental capacity.

The donor must be acting freely and voluntarily. If there is any doubt about undue influence, the deed should be executed before an independent solicitor.

Donee (Recipient)

The person receiving the gift.

A minor cannot hold property directly. A parent or guardian must accept and hold the gift on trust until the donee turns 21.

Stamp duty reminder: Any gift of property or shares must be stamped by IRAS within 14 days if executed in Singapore (30 days if overseas). Duty is assessed on open market value, not on zero consideration. Failure to stamp attracts penalties up to 4Γ— the duty.

Witnesses & Review

Best practice is to have separate witnesses for the Donor and Donee β€” each witness present when their respective signatory signs.

Each witness must be an independent adult who is not a party to the deed, not a beneficiary, and not a close relative of any party.
